Terms of Services

Rocket IGS is an industrial performance guidance platform that provides real-time performance monitoring, course-correction tools, and crew-level dashboards to help organizations launch operational performance to new heights. The Services are intended strictly for industrial and business use by authorized personnel.

The Services are not tailored to comply with industry-specific regulations such as HIPAA or FISMA. If your use of the Services would subject you to such regulations, you may not use the Services. The Services may not be used in any manner that would violate the Gramm-Leach-Bliley Act (GLBA).

Users who access the Services from outside the United States do so on their own initiative and are solely responsible for compliance with applicable local laws.

Our Intellectual Property

Reliability Excellence LLC owns or is the licensee of all intellectual property rights in Rocket IGS, including all source code, databases, algorithms, software, platform designs, dashboards, visualizations, text, graphics, and documentation (collectively, the "Content"), as well as all trademarks, service marks, and logos (the "Marks"). The Rocket IGS name, brand, and platform design are proprietary to Reliability Excellence LLC.

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Services solely for your internal business purposes. You may not copy, reproduce, modify, distribute, sell, sublicense, reverse-engineer, or create derivative works of any part of the Services without our express prior written permission.

Your Submissions

By sending us any feedback, suggestions, or ideas regarding Rocket IGS, you assign to us all intellectual property rights in such submissions. We may use your feedback freely for any lawful purpose without acknowledgment or compensation.

By using Rocket IGS, you represent and warrant that: (1) all registration information you submit is true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity and authority to enter into these Legal Terms; (4) you are not a minor in your jurisdiction; (5) you will not access the Services through automated or non-human means; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use of the Services will not violate any applicable law or regulation.

Access to Rocket IGS requires registration. You agree to keep your credentials confidential and are responsible for all activity that occurs under your account. We reserve the right to remove, reclaim, or change a username we determine, in our sole discretion, to be inappropriate or objectionable. Each user account is personal and may not be shared or transferred without written consent.

Rocket IGS is offered on a subscription basis. Access to features, dashboards, and crew management tools is determined by your subscription tier. We reserve the right to modify, discontinue, or update platform features at any time. Specific feature sets associated with each subscription tier are described on the Platform and are subject to change with notice.

We accept the following forms of payment: Visa, Mastercard, American Express, Discover, PayPal, and Stripe. All payments are denominated in US dollars. You agree to provide accurate and current payment information and authorize us to charge your chosen payment method for any amounts due. We reserve the right to correct pricing errors and to refuse or cancel any order at our discretion.

Billing and Renewal

Your Rocket IGS subscription will automatically renew at the end of each billing cycle unless cancelled. By subscribing, you consent to recurring charges without requiring separate approval for each renewal. Billing cycles are annual unless otherwise specified at purchase.

Cancellation

You may cancel your subscription at any time by logging into your account or by contacting us at admin@reliabilityx.com. Cancellation takes effect at the end of the current paid term. Access to the platform continues until the end of the billing period.

Fee Changes

We may modify subscription fees from time to time and will provide notice of any pricing changes in accordance with applicable law.

All sales are final. No refunds will be issued for subscription fees paid, partial periods, or unused access. If you believe a charge was made in error, contact us at admin@rocketigs.com and we will investigate.

You may not use Rocket IGS for any purpose other than its intended industrial performance management functions. The following activities are expressly prohibited:

• Scraping, harvesting, or systematically extracting data from the Platform without written permission.
• Attempting to gain unauthorized access to any part of the Services, other user accounts, or our infrastructure.
• Reverse engineering, decompiling, or disassembling any software component of Rocket IGS.
• Uploading or transmitting malware, viruses, or any code designed to disrupt or damage the Services.
• Using the Services to compete with ReliabilityX or to build a substantially similar product.
• Sharing, reselling, or sublicensing your account access to third parties without written authorization.
• Using automated scripts, bots, or data mining tools against the Platform.
• Impersonating another user, employee, or entity.
• Using the Services in any manner that violates applicable laws or regulations.
• Posting or transmitting content that is defamatory, harassing, discriminatory, or otherwise harmful.

The Services may allow you to submit performance data, notes, reports, or other content ("Contributions"). You represent and warrant that: (1) you own or have the rights to submit your Contributions; (2) your Contributions do not infringe any third-party intellectual property rights; (3) your Contributions are accurate and not misleading; and (4) your Contributions comply with all applicable laws. You are solely responsible for the accuracy and legality of data entered into Rocket IGS.

By submitting Contributions through Rocket IGS, you grant Reliability Excellence LLC a non-exclusive, worldwide, royalty-free license to use, store, process, and display such Contributions solely for the purpose of providing and improving the Services. We do not claim ownership of your operational data. You retain full ownership of all Contributions. We will handle your Contributions in accordance with our Privacy Policy.

If the Platform provides functionality for reviews or ratings of features, integrations, or services, any review you post must be based on genuine firsthand experience, must not contain offensive or discriminatory language, must not include false or misleading statements, and must not be submitted as part of an organized campaign. We reserve the right to remove any review that violates these guidelines.

Rocket IGS may integrate with or link to third-party services, including data sources, ERP systems, or analytics tools. We do not control, endorse, or assume responsibility for any third-party content, services, or practices. Your use of third-party integrations is governed by those parties' own terms and policies. This platform may also integrate or link to third-party services including YouTube; we are not responsible for the content or practices of such services.

We reserve the right to: (1) monitor the Platform for violations of these Legal Terms; (2) take appropriate action against users who violate applicable law or these terms; (3) remove or restrict access to any Contributions or user content; (4) suspend or terminate accounts without notice for material breach; and (5) manage the Services in a manner designed to protect our rights, property, and the integrity of the platform.

We are committed to protecting your data. Please review our Privacy Policy at Privacy Policy. By using Rocket IGS, you agree to our data practices as described therein. The Services are hosted in the United States. If you access the Services from outside the US, you consent to having your data transferred to and processed in the United States.

We respect intellectual property rights. If you believe any material on the Platform infringes your copyright, please contact our Designated Copyright Agent:

Your notice must comply with DMCA 17 U.S.C. § 512(c)(3) and include: (1) your signature or that of an authorized representative; (2) identification of the copyrighted work; (3) identification of the infringing material and its location; (4) your contact information; (5) a good faith belief statement; and (6) a statement of accuracy under penalty of perjury.

THESE LEGAL TERMS REMAIN IN FULL FORCE WHILE YOU USE THE SERVICES. WE RESERVE THE RIGHT, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, TO DENY ACCESS TO ANY PERSON FOR ANY REASON, INCLUDING BREACH OF THESE LEGAL TERMS. WE MAY TERMINATE OR SUSPEND YOUR ACCOUNT AT ANY TIME.

Upon termination, you are prohibited from creating a new account without our written consent. We reserve the right to pursue civil, criminal, or injunctive remedies where appropriate.

We reserve the right to modify, update, suspend, or discontinue Rocket IGS at any time without notice. We will not be liable for any modification, suspension, or discontinuance of the Services. We do not guarantee uninterrupted availability and may perform maintenance that causes temporary outages.

These Legal Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.

Informal Negotiations

Before initiating arbitration, the parties agree to attempt informal resolution for at least 30 days, beginning upon written notice from either party.

Binding Arbitration

Unresolved disputes will be settled by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA), conducted in Lehigh, Pennsylvania.

YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.

No arbitration shall be conducted on a class-action basis. The parties agree to individual arbitration only. No dispute may be commenced more than one (1) year after the cause of action arose.

Exceptions

The following disputes are not subject to arbitration: (a) disputes involving intellectual property rights; (b) claims arising from theft, piracy, or unauthorized use; and (c) claims for injunctive relief.

We reserve the right to correct any typographical errors, inaccuracies, or omissions on the Platform at any time without prior notice, including information related to pricing, features, and availability.

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF PERFORMANCE DATA GENERATED OR DISPLAYED THROUGH ROCKET IGS. THE PLATFORM IS A DECISION-SUPPORT TOOL; OPERATIONAL DECISIONS REMAIN SOLELY YOUR RESPONSIBILITY.

IN NO EVENT WILL RELIABILITY EXCELLENCE LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF ROCKET IGS, INCLUDING LOST PROFITS, PRODUCTION LOSSES, OR DATA LOSS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE SHALL NOT EXCEED THE GREATER OF THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR $100,000.00 USD.

You agree to defend, indemnify, and hold harmless Reliability Excellence LLC and its affiliates, officers, agents, partners, and employees from any claims, losses, liabilities, or expenses (including attorneys' fees) arising from: (1) your use of the Services; (2) your Contributions; (3) your breach of these Legal Terms; (4) your violation of any third-party rights; or (5) any harmful act toward another user.

We will maintain operational and account data you transmit to Rocket IGS for the purpose of delivering the Services. While we perform routine backups, you are solely responsible for maintaining independent copies of critical operational data. We shall have no liability for any loss or corruption of such data, and you waive any right of action against us arising therefrom.

By using Rocket IGS, you consent to receive communications from us electronically. All agreements, notices, and disclosures delivered electronically satisfy any legal requirement that such communications be in writing. You agree to the use of electronic signatures and records in connection with the Services.

These Legal Terms, together with our Privacy Policy and any posted operating rules, constitute the entire agreement between you and Reliability Excellence LLC regarding Rocket IGS. Our failure to enforce any provision does not constitute a waiver. If any provision is found unlawful or unenforceable, it shall be severed without affecting the remaining provisions. We may assign our rights and obligations under these terms at any time. No joint venture, partnership, employment, or agency relationship is created by these terms.
